Fruitsy Terms of Use

Welcome to Fruitsy ("the App"), developed and operated by Glam Dietitian ("we", "us", or "our", Application ID: com.glamdietitian.fruitsy).

Please read these Terms of Use ("Terms") carefully. By downloading, accessing, or using Fruitsy, you ("you", "User", or "Parent/Guardian") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the App.

1. Parental Consent and Supervised Use

  • Target Audience: Fruitsy is designed for educational entertainment for children aged 2 through 10.
  • Parental Responsibility: If the user of the App is under the age of majority in your jurisdiction, you represent and warrant that you are their parent or legal guardian, that you have reviewed these Terms, and that you give full consent for the child to use the App under your supervision.
  • Parental Gate: Fruitsy provides a PIN-protected "Parents' Corner" dashboard. You are responsible for maintaining the confidentiality of your chosen 4-digit PIN.

2. License Grant

Subject to your compliance with these Terms, Glam Dietitian grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Fruitsy on your personal mobile devices solely for your personal, non-commercial, educational use.

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Modify, adapt, translate, or create derivative works based on the App or its graphical assets.
  • Rent, lease, lend, sell, sublicense, or distribute the App or any digital assets contained therein.
  • Extract or scrape any fruit illustrations, character graphics, sound effects, audio tracks, or database files for use outside the App.

3. Educational & Nutritional Disclaimer (Important)

  1. Gamified Education Only: Fruitsy provides fun facts, nutritional summaries (e.g., vitamins, general calorie references, growth habits), and interactive smoothie recipes to encourage healthy interest in fresh fruits.
  2. Not Medical or Dietary Advice: All educational and nutritional information presented within the App is provided for general informational and entertainment purposes only. It does not constitute pediatric, medical, dietetic, nutritional, or clinical healthcare advice.
  3. Allergies & Dietary Restrictions: Real-world fruit consumption, smoothie preparation, and food handling must always be supervised by a parent or adult caregiver, particularly with regard to food allergies, choking hazards for young toddlers, and individual health conditions. Always consult a qualified healthcare or pediatric nutrition professional for specific dietary concerns.

4. Camera & Device Hardware Use

  • The "Fruit Scanner" feature requires temporary camera access to identify fruits using on-device computer vision.
  • Camera frames are processed strictly in real time in temporary device memory and are never recorded, saved, or uploaded.
  • You agree that children will only use the camera feature in safe physical environments under adult supervision to prevent physical collisions, drops, or property damage.

5. Intellectual Property Rights

The App, including but not limited to its source code, design, artwork, fruit illustrations, pixel art, UI components, animations, sound effects, music tracks, and trademarks ("Fruitsy", "Glam Dietitian"), are the exclusive intellectual property of Glam Dietitian or its licensors. All rights not expressly granted to you under these Terms are reserved.

6. Device Storage, Offline Operation, and Backups

  • Fruitsy operates 100% locally on your device without user accounts or cloud storage synchronization.
  • Data Retention & Loss: Your child's progress, sticker collections, and garden items exist solely in your device's local memory. If you uninstall the App, reset your device, or clear the App's data storage, your progress will be permanently erased. Glam Dietitian has no access to your device and cannot restore lost gameplay records.
  • You may reset all game records at any time via the "Clear All Data" control in Parents' Corner.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, FRUITSY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GLAM DIETITIAN EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GLAM DIETITIAN, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, DEVICE DAMAGE, PERSONAL INJURY, OR OTHER INTANGIBLE LOSSES) ARISING FROM OR RELATED TO YOUR OR YOUR CHILD'S USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW OR THE AMOUNT PAID BY YOU FOR THE APP (IF ANY).

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. When updates occur, we will revise the "Last Updated" date at the top of this document. Continued use of the App following any changes indicates your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions, or the applicable consumer protection laws of your jurisdiction where required by local statute.
